Informed consent to
the provision of treatment to a patient can be given by —
(a) the
patient; or
(b) if
the patient does not have the capacity to make a treatment decision about the
provision of the treatment to himself or herself — the person who is
authorised by law to make the treatment decision on the patient’s
behalf.
Notes for this section:
1. An adult can give
informed consent by making an advance health directive (see the GAA Act
section 110ZJ(2)).
2. An adult’s
enduring guardian or guardian, or the person responsible for an adult, can
give informed consent on the adult’s behalf (see the GAA Act section
110ZJ(3) to (5)).
3. A child’s
parent or guardian can give informed consent on the child’s behalf
unless the child has the capacity to give informed consent (see
section 302(3)).
