(1) A patient may, at
any time while admitted by a hospital, request an interview with a
psychiatrist.
(2) The person in
charge of the hospital must ensure —
(a)
that, unless subsection (4) applies, the request is complied with within a
reasonable time after the request is made; and
(b) that
a record of the request having been made is filed.
(3) The psychiatrist
who interviews a patient in compliance with a request made under subsection
(1) must file a record of —
(a) the
date and time when the interview occurred; and
(b) the
matters discussed during the interview.
(4) A psychiatrist may
refuse a patient’s request for an interview under subsection (1) if
—
(a) the
patient has a history of making repeated requests under subsection (1); and
(b) the
psychiatrist is satisfied that the patient is acting unreasonably in making
the request.
(5) A psychiatrist who
refuses a patient’s request under subsection (4) must file a record of
the reasons for refusing and give a copy to the patient.
