A mental health
advocate who under section 359(1)(f) inspects, or takes a copy of the whole or
any part of, a document must not disclose any information in the document if
—
(a) the
identified person to whom the document relates has been refused access to the
document for a reason referred to in section 249(1)(a) or (b) or (3); and
(b)
before the document was made available to the mental health advocate in
compliance with a requirement by the mental health advocate under
section 359(1)(e)(ii), the mental health advocate was advised of the matters
referred to in section 360(2)(a) and (b).
Penalty: a fine of $5 000.
