(1) The Tribunal may
declare that a nomination is valid or invalid.
(2) Instead of
declaring that a nomination is invalid because of a failure to comply with
section 275, the Tribunal —
(a) may
declare the nomination to be valid; and
(b) may
make an order varying the terms of the nomination in the manner the Tribunal
considers most likely to give effect to the intention of the person who made
the nomination.
(3) A declaration made
under subsection (1) or (2)(a) has effect according to its terms.
