(1) This section
applies in relation to a person —
(a) in
respect of whom an order under the 1996 Act section 20 was in force
immediately before commencement day; and
(b) who
is a mental health practitioner as defined in section 4.
(2) The person is
taken to be an authorised mental health practitioner as defined in section 4
—
(a) who
is designated as such by the order to which subsection (3) applies; and
(b) who,
in performing the functions of an authorised mental health practitioner, is
subject to the limits to which subsection (3) applies.
(3) The order referred
to in subsection (1)(a) is taken to be an order made under section 539
specifying as the limits within which the functions of an authorised mental
health practitioner can be performed by the person the limits that were
specified under the 1996 Act section 20 immediately before commencement day as
the limits within which the person could have performed the functions of an
authorised mental health practitioner under that Act.
