(1) A person commits a
simple offence if the person manufactures a psychoactive substance.
Penalty: a fine of $48 000 or imprisonment for 4
years or both.
(2) A person commits a
simple offence if the person sells or supplies a psychoactive substance.
Penalty: a fine of $48 000 or imprisonment for 4
years or both.
(3) For the purpose of
deciding whether or not a person has committed an offence under subsection (1)
or (2) in relation to a substance, it is irrelevant that usage instructions
concerning the substance given in any manner or form indicate that the
substance is not a psychoactive substance or that it is not intended for human
consumption.
