(1) A body corporate
with perpetual succession is hereby established under the name “The
National Trust of Australia (W.A.)” which shall consist of the persons
who —
(a) were
members of the Association immediately before the coming into operation of
this Act; and
(b)
under the rules of The Trust for the time being in force are members thereof,
and after the
constitution of the Council under section 10, the persons who from time to
time hold office as appointed councillors under that section.
(2) The Trust —
(a)
shall have a common seal;
(b) has,
subject to this Act, power to acquire, hold and dispose of real and personal
property;
(c) has
power to borrow money either with or without security;
(d) may
sue and be sued in its corporate name; and
(e) is
capable of doing and suffering all that bodies corporate may do and suffer.
