A person who is the
Commissioner, the Deputy Commissioner or a member of the Commissioner’s
staff authorised for the purposes of this section by the Commissioner or the
Deputy Commissioner may disclose information obtained by the Commissioner, the
Deputy Commissioner or a member of the Commissioner’s staff in the
course of, or for the purpose of, an investigation under this Act (other than
an investigation conducted for the purposes of the reportable conduct scheme)
if the information —
[(a) deleted]
(aa) is
disclosed to a person who is —
(i)
the Inspector of Custodial Services; or
(ii)
a member of the staff of the Inspector authorised for the
purposes of this subparagraph by the Inspector,
and concerns a matter
that is relevant to the functions of the Inspector; or
(b) is
disclosed to a person who is —
(i)
the Director of Public Prosecutions; or
(ii)
the Deputy Director of Public Prosecutions; or
(iii)
a member of the staff of the Director of Public
Prosecutions authorised for the purposes of this subparagraph by the Director
of Public Prosecutions or the Deputy Director of Public Prosecutions,
and concerns a matter
that is relevant to the functions of any of the following —
(iv)
the Corruption and Crime Commission;
(v)
the Parliamentary Inspector;
(vi)
the Public Sector Commissioner, but only those functions
under the Corruption, Crime and Misconduct Act 2003 ;
(vii)
the Director of Public Prosecutions;
or
(c) is
disclosed to —
(i)
the Corruption and Crime Commission; or
(ii)
a person who is an officer of the Corruption and Crime
Commission authorised for the purposes of this subparagraph by the Corruption
and Crime Commission,
and concerns a matter
that is relevant to the functions of the Corruption and Crime Commission; or
(d) is
disclosed to a person who is —
(i)
the Parliamentary Inspector of the Corruption and Crime
Commission; or
(ii)
an officer of the Parliamentary Inspector of the
Corruption and Crime Commission authorised for the purposes of this
subparagraph by the Parliamentary Inspector,
and concerns a matter
that is relevant to the functions of the Parliamentary Inspector; or
(ea) is
disclosed to —
(i)
the Public Sector Commissioner; or
(ii)
a person who is authorised by the Public Sector
Commissioner for the purposes of this subparagraph,
and concerns a matter
that is relevant to the functions of the Public Sector Commissioner under the
Corruption, Crime and Misconduct Act 2003 ; or
(e) is
disclosed to a person who is —
(i)
the Commissioner for Children and Young People; or
(ii)
a member of the staff of the Commissioner for Children
and Young People authorised for the purposes of this subparagraph by the
Commissioner for Children and Young People,
and concerns a matter
that is relevant to the death of a child.
