(1) Where, in the
course of an investigation under this Act, the question arises as to whether
the Commissioner has jurisdiction to conduct the investigation, the
Commissioner, or the party the subject of the investigation, may make an
application to the Supreme Court for a determination of that question, and, on
the application, the Court may make such order as it considers proper.
(2) References in this
section, in relation to an investigation into any action taken by or on behalf
of an authority, to the party subject to the investigation shall be construed
as references to that authority or the principal officer thereof.
(3) References in this
section, in relation to an investigation for the purposes of the reportable
conduct scheme, to the party subject to the investigation include references
to the relevant entity or the head of the relevant entity.
