seized under this Part is forfeited under this Division, the enforcement
agency concerned becomes satisfied that there has been no contravention of
this Act of which the item is evidence, the enforcement agency must, as soon
as is practicable, cause the item to be delivered to —
(a) the
person from whom it was seized; or
(b) any
other person who appears to the enforcement agency to be entitled to it.
