(1) In this section
—
confidential information includes information that
the person has a duty to keep confidential, regardless of how the duty of
confidentiality arises.
(2) A person who,
without lawful authority, directly or indirectly, uses or discloses
confidential information obtained by reason of any function that the person
has, or at any time had, in the administration of this Act or the
Health (Miscellaneous Provisions) Act 1911 Part XI commits an offence.
Penalty for an offence under this subsection: a
fine of $20 000.
