(1) The regulations
may declare —
(a) a
disease to be a notifiable infectious disease; or
(b) a
notifiable infectious disease to be an urgently notifiable infectious disease;
or
(c) a
notifiable infectious disease to be a vaccine preventable notifiable
infectious disease.
(2) The Minister may,
if he or she considers it to be necessary in the interests of public health
because of urgent circumstances, by order declare —
(a) a
disease to be a notifiable infectious disease; or
(b) a
notifiable infectious disease to be an urgently notifiable infectious disease;
or
(c) a
notifiable infectious disease to be a vaccine preventable notifiable
infectious disease.
(3) A notifiable
infectious disease that is declared to be —
(a) an
urgently notifiable infectious disease may also be declared to be a vaccine
preventable notifiable infectious disease; and
(b) a
vaccine preventable notifiable infectious disease may also be declared to be
an urgently notifiable infectious disease.
(4) If there is any
conflict or inconsistency between a declaration by the regulations under
subsection (1) and a declaration by the Minister under subsection (2), the
Minister’s declaration prevails.
