(1) A person who fails
to notify the Chief Health Officer in accordance with section 94 commits an
offence.
Penalty for an offence under this subsection: a
fine of $10 000.
(2) In any proceedings
against a person for an offence under subsection (1) of failing to notify the
Chief Health Officer, it is a defence to prove that the person believed on
reasonable grounds that another person had given the Chief Health Officer the
required notification.
