(1) Notwithstanding
section 5(3), the Health (Miscellaneous Provisions) Act 1911 applies to and
in relation to all acts, omissions and circumstances of or pertaining to the
Authority and any other person in relation to the Island.
(2) For the purposes
of subsection (1), the Island is a health district and the Chief Health
Officer is the local government for the Island in accordance with section 16
of the Health (Miscellaneous Provisions) Act 1911 .
(3) Without limiting
subsection (2), the Chief Health Officer may, in relation to the Island,
exercise any power to make local laws that is conferred on a local government
by the Health (Miscellaneous Provisions) Act 1911 .
(4) Nothing in this
section affects —
(a) the
application that the Health (Miscellaneous Provisions) Act 1911 would have to
any person, act, omission or circumstance if subsection (1) had not been
passed; or
(b) the
operation of section 343A of that Act.
