(1) If the register
contains a notation that a person has a security interest in a licence, the
licensee may apply to the CEO in a form approved by the CEO to —
(a)
remove the notation from the register; or
(b) vary
any details relating to the security interest.
(2) Where an
application is made under subsection (1), the CEO —
(a) is
to give notice of the application to a person noted on the register as having
a security interest in the licence; and
(b) must
not remove the notation of the security interest from the register or vary the
details in the register (as the case requires) unless —
(i)
each person noted on the register as having a security
interest in the licence consents in writing to the CEO doing so; or
(ii)
a court authorises or directs the CEO to do so, at the
suit of the licensee, a person referred to in subparagraph (i) or some other
interested person.
