(1) In this section
—
required documents means all of the following
documents —
(a) a
copy of the proposed agreement;
(b) a
disclosure statement in the approved form (if any);
(c) a
copy of the information booklet in the approved form (if any);
(d) a
copy of any park rules that apply to the residential park where the site the
subject of the long-stay agreement is located;
(e) any
other prescribed document.
(2) A park operator
must give the required documents to a person before entering into a long-stay
agreement with the person —
(a) for
a site-only agreement — at least 5 working days before the agreement is
signed; or
(b)
otherwise — before the agreement is entered into.
Penalty for this subsection: a fine of $5 000.
(3) However,
subsection (2)(a) does not apply if the person who intends to enter into the
site-only agreement —
(a) owns
a relocatable home that is a vehicle for which a vehicle licence has been
granted under the Road Traffic (Vehicles) Act 2012 ; and
(b)
states in writing to the park operator that the person does not require the
required documents to be given to the person at least 5 working days before
the agreement is signed; and
(c) is
given the required documents by the park operator before the person occupies
the site or other park premises in the residential park.
