Western Australian Current Acts Western Australian Current Acts (1) This section
applies if a motor vehicle has been towed in compliance with the requirements
of this Division.
(2) A relevant person
for the vehicle is liable for the payment of towing charges and storage
charges imposed in relation to the vehicle in compliance with the requirements
of this Division and the regulations.
(3) If a relevant
person who pays an amount referred to in subsection (2) was not driving or
otherwise in charge of the vehicle when the vehicle was parked before it was
towed, the person driving or otherwise in charge of the vehicle is liable to
that relevant person for the amount paid by that relevant person.
(4) If a person (the
debtor ) does not pay an amount required by this section, the person entitled
to be paid may recover the amount in a court of competent jurisdiction as a
debt due from the debtor.
