(1) If —
(a) a
responsible person for a vehicle who is given a surrender notice under
section 79BA fails to surrender the vehicle specified in the notice according
to the notice; or
(b) a
responsible person for a vehicle who is given a surrender substitute vehicle
notice under section 79BCA fails to surrender the substitute vehicle specified
in the notice according to the notice; or
(c) a
responsible person for a vehicle who is given a surrender alternative vehicle
notice under section 79BCD fails to surrender the alternative vehicle
specified in the notice according to the notice,
the Commissioner may
request the CEO to suspend the licence in respect of the vehicle until the
vehicle is impounded under this Division or the Commissioner requests the CEO
to revoke the suspension.
(2) The Commissioner
is required, on being satisfied that a circumstance described in a paragraph
of section 79D(2) exists, to request the CEO to revoke the suspension and may,
if for any other reason the Commissioner considers it appropriate to do so,
request the CEO to revoke the suspension.
(3) While the licence
in respect of a vehicle is suspended according to a request under this section
—
(a) the
licence is of no effect; and
(b) an
application to renew the licence cannot be granted, even if the application
was made before the licence was suspended.
(4) The suspension
does not extend the period for which the licence may be valid or effective
beyond the expiration of the period for which the licence was expressed to be
granted or renewed.
