(1) When a
driver’s licence under this Act is obtained by a person for whom,
immediately before the person obtains the licence, another jurisdiction was
the demerit point registry jurisdiction (the former demerit point registry
jurisdiction ), the CEO is to cause to be recorded against the person in the
demerit points register —
(a) any
national demerit point offence (as defined in this Act) that —
(i)
immediately before the person obtains the driver’s
licence, stands recorded against the person under a law of the former demerit
point registry jurisdiction corresponding to this Part; and
(ii)
is not already recorded in the demerit points register;
and
(b)
demerit points for, and other details of, any offence required by paragraph
(a) to be recorded against the person.
(2) The number of
demerit points to be recorded for the offence is the number of points that
were recorded against the person for the offence under the law of the former
demerit point registry jurisdiction.
(3) Subsection (1)
does not require an offence to be recorded if it was committed or allegedly
committed more than 3 years before the day on which the offence would
otherwise be required to be recorded in the demerit points register, and
section 48 applies also to demerit points for an offence recorded under this
section.
