RETIREMENT VILLAGES ACT 1992 - SECT 67

67 .         Liability of resident remaining in possession

        (1)         If a resident of a retirement village refuses or fails to comply with an order to give possession of residential premises in the retirement village to another person on a fixed date, the resident is liable to pay compensation to the operator of the retirement village for any loss caused to the operator by that refusal or failure.

        (2)         The Tribunal may, on application by an operator under this section made not later than 30 days after the day on which the order fixing the date to give possession took effect, order the resident to pay to the operator such compensation as the Tribunal thinks fit.
