(1) In this section
—
commencement means the coming into operation of
the Sentencing Legislation Amendment Act 2016 Part 4 Division 2.
(2) This Act, as
amended by the Sentencing Legislation Amendment Act 2016 Part 4 Division 2,
applies to the determination under section 146 of whether an offence was
committed in circumstances of aggravation —
(a) even
if the offence was committed before commencement; and
(b) even
if the offender pleaded guilty before commencement; and
(c) even
if the determination has arisen as a result of an appeal against a sentence
imposed before commencement.
