(1) Subject to
sections 94A, 94 and 95A, a prisoner serving a parole term is eligible to be
released on parole —
(a) if
the term served is 4 years or less — when he or she has served one-half
of the term; or
(b) if
the term served is more than 4 years — when he or she has served 2 years
less than the term.
(2) Any order for the
release on parole of a prisoner to whom subsection (1) applies must be made in
accordance with Part 3 of the Sentence Administration Act 2003 .
(3) If a prisoner
serving a parole term has not been released on parole before the term ends,
the prisoner is discharged from that sentence when the term ends and, subject
to Part 2 Division 2 of the Sentence Administration Act 2003 , must be
released then.
