arrangement is not enforceable except to the extent provided for in subsection
(3).
(2) Subsection (1)
does not affect the ability of the court to make an order under Part 3.
(3) An obligation
under a surrogacy arrangement to pay or reimburse reasonable expenses referred
to in section 6(1) is as enforceable as it would be if subsection (1) had not
been enacted and the arrangement was not unenforceable for any other reason.
