(1) Where an order
made under section 74 authorises the Commissioner to appoint a supervisor, the
Commissioner during the currency of the order —
(a) may,
on such terms and conditions as to remuneration and indemnity as the
Commissioner thinks fit appoint a person, licensed or unlicensed, as
supervisor of the business of the settlement agent or deceased settlement
agent referred to in the order; and
(b) may
authorise the supervisor to obtain an advance from the Treasurer on such terms
and conditions as the Treasurer thinks fit, for the purpose of carrying on the
business of the settlement agent or deceased settlement agent; and
(c) may
determine what, if any, proportion of remuneration or other proper charges
recovered on account of the settlement agent or deceased settlement agent,
shall be paid to the settlement agent or the personal representative of the
deceased settlement agent and what proportion shall be paid to the
Commissioner towards the expenses and remuneration of the supervisor and for
reimbursement of advances made under paragraph (b).
(2) An appointment of
a supervisor shall be in writing.
