(1) Any period that a
prisoner spends on bail while he or she is appealing against a conviction or a
sentence does not count as time served in respect of any term that the
prisoner is liable to serve.
(2) Any period that a
prisoner spends in custody while he or she is appealing against a conviction
or a sentence counts as time served in respect of any term that he or she is
then serving, but not in respect of any other term that he or she is liable to
serve.
