(1) If a person
—
(a) is
convicted of an offence under section 101 in respect of a river protection
notice; or
(b) in
the opinion of the CEO, has not complied with a requirement of a river
protection notice within such time as is specified in the notice, then,
subject to subsection (2),
the CEO may take such
action as is necessary under section 103 to ensure that the requirements of
the notice are complied with.
(2) Before taking
action under section 103 in the circumstances referred to in subsection
(1)(b), the CEO must give to the person written notice —
(a)
stating that in the opinion of the CEO the person has not complied with the
requirement, or requirements, of the river protection notice which is, or are,
specified in the notice under this subsection; and
(b)
giving details of the proposed action.
