(1) An account called
the Swan and Canning Rivers Foundation Account is to be established —
(a) as
an agency special purpose account under the Financial Management Act 2006
section 16; or
(b) with
the approval of the Treasurer, at a bank as defined in section 3 of that Act,
to which the funds
received by the Foundation must be credited.
(2) The Foundation
Account is to be charged with all expenditure lawfully incurred by the
Foundation in the performance of its functions.
(3) Moneys standing to
the credit of the Foundation Account —
(a) are
subject to the direction and control of the CEO; and
(b) may
be transferred to an operating account of the Department for the purposes of
carrying this Act into effect or otherwise applied for the purposes of this
Act or the Foundation.
(4) The operation of
the Foundation Account is to be regarded as —
(a) a
service under the control of the Department for the purposes of the
Financial Management Act 2006 section 52; and
(b) part
of the operations of the Department for the purposes of Part 5 of that Act.
