(1) In subsection (2)
—
eligible person means —
(a) a
member;
(b) a
committee or a member of the committee;
(c) the
CEO;
(d) a
member of staff provided under section 28A.
(2) The Trust may, by
resolution, delegate to an eligible person any function of the Trust under
another provision of this Act or any other written law.
(3) A delegate must
not further delegate any function.
(4) A person
exercising or performing a function that has been delegated to the person
under this section is to be taken to do so in accordance with the terms of the
delegation unless the contrary is shown.
(5) Nothing in this
section limits the ability of the Trust to perform a function through an
officer or agent.
(6) This section does
not apply to the execution of documents but the authority to execute documents
on behalf of the Trust can be given under section 28F.
