(1) The Tribunal may,
at any time, make an order striking out all, or any part, of a proceeding if
it considers that the matter, or any aspect of it, would be more appropriately
dealt with by another tribunal, a court, or any other person.
(2) The
Tribunal’s power to make an order under subsection (1) is exercisable
only by a judicial member.
(3) If the Tribunal
makes an order under subsection (1), it may refer the matter, or any aspect of
it, to the relevant tribunal, court, or person if it considers it appropriate
to do so.
(4) The Tribunal may
make an order under subsection (1) on the application of a party or on its own
initiative.
