(1) In this section
—
first year of the relevant education period means
—
(a) for
a student enrolled in a school during the pre-compulsory education period
— the first year of that enrolment; or
(b)
otherwise, the first year of the compulsory education period.
(2) A student record
must be opened for every student who is in the first year of the relevant
education period —
(a) by
the principal of the school at which the student is enrolled at the beginning
of the school year; or
(ba) in
the case of a student who at that time is enrolled in a community kindergarten
— by the governing body of the community kindergarten; or
(b) in
the case of a student who at that time —
(i)
is receiving home education; or
(ii)
is an exempt child,
by the chief executive
officer referred to in section 229 of the School Education Act.
(3) The regulations
may provide for the opening of a student record for students for whom —
(a) on
the commencement of the Curriculum Council Amendment Act 2011 section 21, a
student record has not been opened; and
(b) a
student record would not otherwise be required to be opened under this
section.
