(1) A person is not
entitled under section 45(3), 47(2) or 48(5) to have access to a State archive
that contains information about another person’s medical condition or
about another person’s disability (as defined in the
Disability Services Act 1993 ) unless —
(a) the
other person has consented to the person being given access; or
(b) that
information is in a form that does not —
(i)
disclose the identity of the other person; or
(ii)
enable the identity of the other person to be
ascertained.
(2) Subsection (1)
does not apply to a State archive that is at least 100 years old.
