(1) For the purpose of
performing its functions, the Commission may investigate the record keeping of
any government organization, other than a Schedule 3 organization.
(2) For that purpose
the Commission, or a person authorised in writing by it, has all the powers
conferred on a special inquirer by sections 24I and 24J of, and Schedule 4 to,
the Public Sector Management Act 1994 and those provisions apply to and in
relation to —
(a) the
Commission or that person as if it or the person were a special inquirer under
that Act; and
(b) the
investigation as if it were a special inquiry under that Act.
(3) A person
authorised by the Commission under subsection (2) to make an investigation
must —
(a)
within such period as the Commission requires, prepare a report on the
conduct, findings and any recommendations of the investigation; and
(b)
immediately after preparing the report, provide the Commission with a copy of
it.
