(1) The Governor may,
by regulations, establish superannuation schemes for persons who are working,
or have worked, for Employers.
(2) Subject to
subsection (2A), a scheme may provide for the spouses or former spouses of
—
(a)
persons who are working, or have worked, for Employers; or
(b)
persons who are, or will become, entitled to benefits under the
Parliamentary Superannuation Act 1970 ,
to participate in the
scheme.
(2A) A scheme
continued by section 29(1)(b), (c) or (d) may only provide for the matters
referred to in subsection (2) by regulations made in accordance with
section 38(5A)(a).
(3) In subsection (2)
—
benefits has the meaning given to that term in
section 28(1) of the Parliamentary Superannuation Act 1970 ;
spouse , in relation to a person, includes a de
facto partner of that person.
