(1) If the owners of
the lots in a strata titles scheme are jointly entitled to take proceedings
against a person or are liable to have proceedings relating to common property
taken against them jointly, the proceedings may be taken by or against the
strata company and any judgment or order given or made in favour of or against
the strata company in the proceedings has effect as if it were a judgment or
order given or made in favour of or against the owners.
(2) If an owner of a
lot is liable to make a contribution to another owner for a judgment debt
arising under a judgment referred to in subsection (1), the amount of that
contribution must bear to the judgment debt the same proportion as the unit
entitlement of the lot of the first-mentioned owner bears to the sum of the
unit entitlements of all the lots.
