(1) Any person
sustaining loss or damage in any case in which heretofore he would have been
entitled to bring an action to recover damages against the State with the
Registrar as nominal defendant may before commencing proceedings against the
Registrar make application in writing to the Commissioner for compensation and
such application shall be supported by affidavit or declaration.
(2) If the
Commissioner admit the claim or any part thereof and certify accordingly to
the Attorney General thereupon the Governor may if he shall think fit issue a
warrant to the Treasurer for the amount so certified and such amount shall be
charged to the Consolidated Account and paid to the claimant and this section
appropriates the Consolidated Account accordingly.
