(1) An application
must be made in person before a JP unless —
(a) the
warrant is needed urgently; and
(b) the
applicant reasonably suspects that a JP is not available within a reasonable
distance of the applicant.
(2) If subsection
(1)(a) and (b) apply —
(a) the
application may be made to the JP by remote communication; and
(b) the
JP must not grant the application unless satisfied about the matters in
subsection (1)(a) and (b).
