(1) In this section
—
health facility means any of the following —
(a) a
hospital as defined in the Health Services Act 2016 section 8;
(b) a
private psychiatric hostel as defined in the Private Hospitals and Health
Services Act 1927 section 2(1);
(c)
premises where residential care, as defined in the Aged Care Act 1997
(Commonwealth) section 41- 3, is provided;
(d)
premises, other than a private residence, where accommodation and personal
care or nursing care, or both, are provided to a person with a disability;
interpreter , for a patient, means an interpreter
who assists a patient in relation to —
(a) the
request and assessment process; or
(b) the
process for accessing voluntary assisted dying under Part 4; or
(c) a
proceeding under Part 5.
(2) An interpreter for
a patient —
(a) must
be accredited by a body approved by the CEO; and
(b) must
not —
(i)
be a family member of the patient; or
(ii)
know or believe that they are a beneficiary under a will
of the patient or that they may otherwise benefit financially or in any other
material way from the death of the patient; or
(iii)
be an owner of, or be responsible for the day-to-day
management and operation of, any health facility at which the patient is being
treated or resides; or
(iv)
be a person who is directly involved in providing health
services or professional care services to the patient.
