(1) A person to whom
money is to be paid under a conciliation decision or a conciliation agreement
may enforce the conciliation decision or conciliation agreement by filing in a
court of competent jurisdiction (the court ) —
(a) a
copy of the conciliation decision or certificate of outcome that the Director
has certified to be a true copy; and
(b) an
affidavit as to the amount not paid under the conciliation decision or
conciliation agreement.
(2) No charge is to be
made for filing the documents under subsection (1).
(3) On the filing of
the documents under subsection (1), the conciliation decision or conciliation
agreement is to be taken to be an order of the court and, subject to
subsection (4), may be enforced accordingly.
(4) A conciliation
agreement cannot be enforced under subsection (3) before the expiration of the
period of 21 days starting on the day on which the certificate of outcome is
issued.
