(1) In this section
—
chief executive officer , in relation to a
relevant authority, means the principal officer (however described) of that
body;
relevant authority means —
(a) a
public authority; or
(b) any
other body prescribed by the regulations for the purposes of this definition.
(2) The chief
executive officer of a relevant authority may delegate to an officer or
employee of the relevant authority any power or duty of the relevant authority
under this Act.
(3) The delegation
must be in writing signed by the chief executive officer.
(4) A delegation may
expressly authorise the delegate to further delegate the power or duty.
(5) A person
exercising or performing a power or duty that has been delegated to the person
under this section or as authorised under this section is taken to do so in
accordance with the terms of the delegation unless the contrary is shown.
(6) Nothing in this
section limits the ability of the relevant authority to perform a function
through an officer of the relevant authority or an agent.
