If a charge of a
detention offence is referred to a visiting justice and the visiting justice
thinks it appropriate having regard to the nature and particulars of the
alleged offence and the extent of the powers given by section 173, the
visiting justice may decline to deal with the matter and direct the
superintendent to commence a prosecution in a court of summary jurisdiction
for the detention offence.
