(1) In this
regulation —
1987 Act notice means a notice of an address for
service lodged under Associations Incorporation Act 1987
section 40;
address for service means an address or postal
address for service of any process, notice or other document;
commencement day has the meaning given in section
186 of the Act;
existing incorporated association has the meaning
given in section 186 of the Act.
(2) An existing
incorporated association is not required to comply with section 203(1) of the
Act if —
(a)
before the commencement day the association lodged a 1987 Act notice; and
(b) the
information stated in the 1987 Act notice continues to be correct during the
period of 90 days after the commencement day.
(3) Where an existing
incorporated association has not lodged notice of an address for service under
the Act —
(a) the
address for service given in the 1987 Act notice most recently lodged by the
association before the commencement day is taken for the purposes of
section 176 of the Act to have been notified to the Commissioner under
section 174; or
(b) if
the association has not lodged a 1987 Act notice, the address which appears to
the Commissioner to be or most recently to have been the address of the
association is taken for the purposes of section 176 of the Act to have
been notified to the Commissioner under section 174.
(4) An address for
service lodged with the Commissioner under section 203(1)(b) or (2)(b) of
the Act is taken for the purposes of section 176 of the Act to have been
notified to the Commissioner under section 174.
