(1) A livestock
transporter must, if it is reasonably necessary in the circumstances to
segregate the livestock on the vehicle in order to minimise the risk to the
welfare of the livestock, ensure that they are segregated by sufficient
internal partitions so as to minimise the risk to the welfare of the
livestock.
Penalty for this subregulation: a fine of
$7 500.
(2) In complying with
subregulation (1), the livestock transporter must have regard to the
following factors —
(a) the
species and class of the livestock;
(b) the
size and body condition of the livestock;
(c) the
general health of the livestock;
(d)
whether any particular livestock animal is aggressive and, if so, the extent
of the aggression;
(e) the
nature of the journey;
(f) the
type, design and capacity of the vehicle.
