(1) A licensee must
ensure that wall mounted fans at the place —
(a) have
blade guards fitted in accordance with the manufacturer’s instructions;
and
(b) are
located so that blades are at least 2 000 mm above the floor.
(2) A licensee must
ensure that a ceiling mounted fan at the place that has blades
2 400 mm or less above the floor below it is not operated
if —
(a) an
enrolled child is present at the place; and
(b) an
enrolled child has access to the area in which the fan is located.
(3) A licensee must
ensure that free standing fans are not used in indoor or outdoor play areas at
the place.
(4) A licensee must
ensure that free standing fans at the place are located so that children are
adequately protected from inadvertent physical contact with the blades.
Penalty: a fine of $3 000.
