(1) If the
occupier, or another person who apparently represents the occupier, is present
at the place when a search warrant is being executed, the person executing the
warrant must —
(a)
identify himself or herself to that person; and
(b) give
the person a copy of the warrant.
(2) If the occupier,
or another person who apparently represents the occupier, is present at the
place when a search warrant is being executed, the person executing the
warrant is not entitled to exercise any powers under that warrant in relation
to the place unless the person complies with subregulation (1).
(3) In the absence of
the occupier, or another person who apparently represents the occupier, the
person executing the warrant must leave a copy of it at the place.
