(1) An application for
review of a reviewable decision must be made within —
(a) if
notice of the making of the decision is required by the regulations or the
market rules to be given to a person affected by the decision —
28 days after the day on which the notice is given; or
(b) in
any other case — 28 days after the day on which notice of the
making of the decision has been published in accordance with
subregulation (2).
(2) For the purposes
of subregulation (1)(b), notice of a decision has been published if the
notice is published on the market website.
(3) An application for
review of a reviewable decision must —
(a) be
in writing; and
(b)
state the name and address of the applicant; and
(c)
provide details of the decision, including who made the decision and under
which regulation or market rule the decision was made or purportedly made; and
(d)
state how the applicant is adversely affected by the decision.
(4) The Board may
extend the time within which an application for review of a reviewable
decision may be made, and may do so even though the time has elapsed.
(5) The Board must
give written notice of an application for review of a reviewable decision to
the person who made the decision.
