(1) The Chief Health
Officer may, by notice published in the Gazette , do all or any of the
following —
(a)
prohibit the use of a registered pesticide for a specified purpose in the
whole or any part of the State;
(b)
prohibit the use of a registered pesticide for a specified purpose during all
or any part of the year;
(c)
prohibit the use of a registered pesticide for a specified purpose absolutely
or subject to any conditions specified in the notice.
(2) A notice may
relate to —
(a) one
or more specified registered pesticides; or
(b)
registered pesticides of a specified kind; or
(c) all
registered pesticides other than —
(i)
one or more specified pesticides; or
(ii)
pesticides of a specified kind.
(3) A person must not
use a registered pesticide in contravention of a notice under
subregulation (1).
Penalty for an offence under
subregulation (3): a fine of $2 500.
