INDUSTRIAL MAGISTRATES COURTS (GENERAL JURISDICTION) REGULATIONS 2005 - REG 8

8 .         Default by party, Court’s powers to deal with

        (1)         This regulation does not apply to a failure to comply with the judgment of a Court in a case or any order made in or as a consequence of the judgment.

        (2)         If a party does not comply with these regulations, or an order made by a Court, a Court may give default judgment against the party.

        (3A)         Without limiting regulation 6, the Court may exercise its powers under subregulation (2) on the application of a party or on its own initiative.

        (3)         The Court may set aside a default judgment and may do so on any conditions it thinks fit.
