(1) In the case of an
expert review panel constituted by 2 members —
(a) an
act or decision of both members of the panel constitutes an act or decision of
the panel; and
(b) if
the members cannot agree on a matter, another person selected by the convenor
from the experts list must determine the matter as if the person constituted
the expert review panel.
(2) In the case of an
expert review panel constituted by 3 members, an act or decision of a
majority of the members of the panel constitutes an act or decision of the
panel.
