The factors about
which the Relevant Regulator must be satisfied in determining to approve a
Reference Tariff and Reference Tariff Policy are that:
(a) the
revenue to be generated from the sales (or forecast sales) of all Services
over the Access Arrangement Period (the Total Revenue) should be established
consistently with the principles and according to one of the methodologies
contained in this section 8;
(b) to
the extent that the Covered Pipeline is used to provide a number of Services,
that portion of Total Revenue that a Reference Tariff is designed to recover
(which may be based upon forecasts) is calculated consistently with the
principles contained in this section 8;
(c) a
Reference Tariff (which may be based upon forecasts) is designed so that the
portion of Total Revenue to be recovered from a Reference Service (referred to
in paragraph (b)) is recovered from the Users of that Reference Service
consistently with the principles contained in this section 8 ;
(d)
Incentive Mechanisms are incorporated into the Reference Tariff Policy
wherever the Relevant Regulator considers appropriate and such Incentive
Mechanisms are consistent with the principles contained in this section 8; and
(e) any
forecasts required in setting the Reference Tariff represent best estimates
arrived at on a reasonable basis.
