(1) The Commission
may, by written notice given to a member of a committee, remove the member
from office if the Commission is satisfied that the member —
(a) is
incompetent, has misbehaved or has neglected the member’s duties; or
(b) is
suffering from mental or physical incapacity impairing the performance of the
member’s functions; or
(c) has
breached any code of conduct adopted by the Commission and applicable to the
member; or
(d) has
been convicted of an offence punishable by imprisonment for 12 months or
more.
(2) If the member of
the committee is appointed with the approval of the Minister, the Commission
can only remove the member from office with the approval of the Minister.
